Terms of Use

1. Acceptance of Terms

By accessing or using the ClearConsent identity verification service (“Service”) provided by Multify Inc. (“Company,” “we,” “us,” or “our”), you (“Customer”) agree to be bound by these Terms of Use (“Terms”).

2. Limited Scope of Service

The Service is offered exclusively for verifying individual identities and mitigating fraud risk. You shall not use the Service for credit scoring, employment decisions, behavioral profiling, or any purpose unrelated to identity verification.

3. Customer Responsibilities

  • Obtain all necessary consents from end users before collecting personal data.
  • Use verification results solely for lawful compliance and fraud prevention.
  • Maintain adequate security controls when accessing or storing verification data.

4. Intellectual Property

The Service, including underlying software, AI models, and documentation, is owned by the Company or its licensors. No rights are granted except as expressly stated herein.

5. Data Ownership

Customer retains ownership of end-user data it submits. Company retains ownership of derivative data (e.g., risk scores) generated by the Service.

6. Confidentiality

Each party agrees to protect confidential information and use it only for purposes of these Terms.

7. Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We do not warrant that verification results are error-free or that the Service will be uninterrupted.

8. Limitation of Liability

To the fullest extent permitted by law, Company’s aggregate liability arising out of or related to the Service shall not exceed the amounts paid by Customer for the Service during the twelve (12) months preceding the claim. Company shall not be liable for indirect, consequential, or punitive damages.

9. Indemnification

Customer agrees to indemnify and hold Company harmless against claims arising from Customer’s misuse of the Service or violation of these Terms.

10. Suspension & Termination

We may suspend or terminate access to the Service if Customer breaches these Terms or uses the Service in a manner that jeopardizes security, privacy, or compliance.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Austin, Texas.

12. Changes to Terms

We may update these Terms periodically. Continued use after changes constitute acceptance.
